Terms of service
These terms govern your use of the NoteAway application and website.
1. The service
NoteAway helps households record responsibilities, important documents, trusted contacts and handover plans. You must be at least 18 years old and legally able to enter into these terms to create a paid account.
2. Your account and content
You are responsible for accurate account information, keeping your credentials and recovery code secure, and all activity under your account. You retain ownership of the content you add. You give NoteAway the limited permission needed to host, encrypt, process and display that content so we can provide the service.
Do not upload unlawful content, attempt unauthorised access, disrupt the service, misuse invitations, or use NoteAway to harm another person. Only add or share another person's information when you have a lawful basis and appropriate permission to do so.
3. Important limitations
NoteAway is an organisational tool. It does not provide legal, financial, medical or emergency advice; verify a death or incapacity; create legal authority; appoint an executor; guarantee access to an institution; or automatically send death notices. You remain responsible for professional advice, original records and time-sensitive action.
4. Subscriptions and payment
Paid plans and current prices are shown on our pricing page. Subscriptions renew automatically for the selected monthly or annual period until cancelled. Paddle acts as merchant of record and processes billing, taxes and payment details under its own terms. NoteAway does not store full card details.
You may cancel before the next renewal through the subscription-management options made available by Paddle or by contacting us. Cancellation stops future renewal and access continues until the end of the paid period unless otherwise required by law. Refund requests are governed by our refund policy.
5. Availability and changes
We work to keep NoteAway available and secure, but do not guarantee uninterrupted or error-free service. We may change features to improve security, comply with law or operate the service sustainably. If a material change adversely affects a paid subscription, we will provide reasonable notice where practicable.
6. Ending use
You may stop using NoteAway and close your account from the app. Export anything you need first. We may suspend or terminate access for a serious breach, unlawful activity, security risk or non-payment, with notice where reasonably possible.
7. Liability
To the fullest extent permitted by law, NoteAway is provided “as is” and we are not liable for indirect, incidental or consequential loss, lost profits, or loss caused by relying on the service as professional advice or legal authority. Nothing in these terms excludes liability or consumer rights that cannot legally be excluded.
8. Privacy and governing law
Our privacy policy explains how personal information is handled. These terms are governed by the laws of South Africa, without limiting any mandatory consumer protections that apply where you live.
